Yes — but only if used correctly. The critical distinction is between open-source AI tools (like ChatGPT's free tier) and closed-source enterprise tools. Uploading client documents to open AI tools constitutes a data breach and waives legal privilege. Closed-source tools like Microsoft Copilot can be used more safely for tasks like summarising. We help firms understand exactly which tools are safe and how to use them.

Extreme caution is needed. In 2025, the Upper Tribunal warned that putting client documents into ChatGPT "places this information in the public domain, and thus breaches client confidentiality and waives legal privilege." A solicitor was referred to the SRA after admitting to uploading client emails and Home Office decision letters to ChatGPT. We train firms on which AI tools are safe and which are not.

Both the SRA and CLC expect firms to understand the risks of AI tools they use. This includes data protection, client confidentiality, and ensuring the accuracy of AI-generated outputs. Notably, the SRA has also authorised the first purely AI-based law firm (Garfield.Law Ltd), signalling increasing regulatory focus.
